Anne Pederson, 74, Nov 29 2010, murdered with gunshots and knives, Irene Park home, Klerksdorp.

2010-11-30 Klerksdorp.  74-year-old retired teacher Mrs Ann Pederson was attacked and murdered in her home in Irene Park, Klerksdorp. She sustained bullet- and slashing-wounds. Hardened policemen said they were ‘shocked’ by the method in which Mrs Pederson was murdered. She was a beloved teacher who taught at the Klerksdorp Primary school for some 35 years. She lived with her businessman-husband Torben in the home where she was attacked at around 9am on November 29 2010 by several black men. The local police immediately started following a trail with tracker-dogs. It’s not certain whether anything was stolen.

Mr Pederson said that they would have celebrated their 51st wedding anniversary on December 12. The Pederson-couple were well-known Rotarians in town. Their family friend Ms Petro Nel, a DA-opposition party councillor, said she was very angry about the murder of ‘her dear and very humane friend’. “She has left deep tracks in the local community. The ANC will only hear early next year whether their application will succeed. Judge Leon Halgryn argued during the application yesterday that he still feels strongly that the ANC’s public singing of the words “Shoot the Boer’ (Dubulíbhunu) is an incitement to genocide and is hatespeech. “It is my opinion that the words ‘Shoot the Boer’ are inciting. It’s a crime.’

He cross-questioned the ANC’s legal counsel Advocate Gilbert Marcus about the appropriateness of still singing this song in the present time. “I realised that the song did form a part of the proud history of the ANC but good heavens is there really stilll an appropriate place for it today?”, he asked.

He will only deliver judgment early next year whether leave to appeal will be granted to the ANC. The ANC had lodged yesterday’s application because, they claimed, judge Halgryn ‘had not taken the historical context of the song into consideration in his ruling’.

The two men have since then come to an ameniable agreement about the matter.

Pro-Afrikaans-Action group members also demonstrated outside the court on the steps, headed by leader Dr Dan Roodt. They tore up copies of the SA Constitution saying that ‘this Constitution provides us Afrikaners no protection. If you say ‘kill the Boer’ it’s an incitement to genocide’. SA education in crisis: 6 million young people 18 and older ‘do not work, do not study, are not being taught anything’…

Only 6,5% of the white pupils, and 2,5% of black scholars expressed an interest in becoming teachers. The alarm was raised by Prof Roger Deacon, honorary-coprofessor at the KwaZulu University, writing in Focus, a journal published by the Helen Suzman Institute. He said it will probably take decades to fix the problem.

There are ‘a great many challenges’ in developing new teachers, he pointed out. “For instance the coordination between the National and Provincial education departments is weak.New, well-trained teachers don’t immediately get hired intoo the system which subsidised their education, and existing qualified teachers are not utilised effectively at schools’.He said there is a ‘negative view of education and the capacity of the present training-instutitions are insufficient. He expressed concern that the large budgets provided for education are often used for ‘other purposes’. Afrikaans defence-force training-officer Marc de Villiers forced to ‘live like beggar’

2010-11-30 LOHATHLA SADF TRAINING CENTRE, NORTH CAPE – Sergeant-major Marc de Villiers, a training-instructor with more than 20 years of military service and an 87% merit-rating this year, is launching an urgent Pretoria High Court application after he was transferred within 24 hours to Pretoria for ‘making a derogatory comment.’ According to the court-records, the officer is now ‘forced to live like a beggar’ because he is not paid any transfer-costs. He landed in trouble with Mrs Brig-genl. Nontobeko Mpaxa, commanding officer, after De Villiers had asked ‘who had taken the idiotic decision for trainees to wear full-dress uniform on parade in the mid-day heat.

He was summonsed to Mrs Mpaxa’s office on October 8 2010 after he’d made the comment to a colleague and rounded on him, telling him that despite his 87% merit-grading at the unit, he was ‘nog good enough to be an instructor, was undiscliplined, that he ‘did not belong in her unit’ and that she was transferring him immediately to Pretoria. He has since then been posted at the Artillery formation in Pretoria because there is no formal post for him. Erica Gibson reports in Beeld. Nobody was thus far able to tell him whether he was being charged for anything. He was given faulty transfer-documents and they also did not contain any financial authorisations to compensate his transfer-expenses. He’s now forced to ‘live like a beggar’ with family members in Pretoria while his family is stuck back in Postmasburg.

His current commanding-officer in Pretoria also cannot help him because Mrs Mpaxa should have applied for his authoritations to the defence force headquarters – but didn’t. He has now been ‘squatting’ in Pretoria for five weeks.  His wife lives in military housing and has a managerial post in Postmasburg because there is no housing available for them in Pretoria. A 61-year-old country club manager from Port Elizabeth was killed in an attempted hijacking, Eastern Cape police said on Tuesday. Walmer Country Club manager Jan Gerrit Hoekstra was on his way to the bank on Monday around 10am, when he was attacked on 9th Avenue in Walmer, said Captain Sandra Janse van Rensburg. “A shot was fired by the suspect who tried to hijack his Opel Astra and he sped away. His car hit another motor vehicle slightly, he swerved to the side and hit a tree on the corner of 8th Avenue and Heugh Road. “The incident was first treated as an accident scene, until paramedics noticed that he had a gunshot wound in his upper body while they were treating him. He later died on the scene,” Janse van Rensburg said. She said nothing was taken from Hoekstra as his money and other valuables were found in the car. 2010-11-21 Kobus Pretorius reports from Durbanville. An Eight-four-year old frail resident of a retirement home opposite Durbanville High School was strangled to death inside her bed on November 20 2010. A nurse found the body of Mrs Cornelia Kilian, 84, in House Aristea in Queen Street. “The nurse noticed that the burglar-bars were torn off a window,’ said sergeant Bernice  Laäs-Bezuidenhout. Her cottage was ‘overturned inside’ but it’s not clear whether anything was robbed. The murder must have taken place between Saturday 22:00 and Monday at noon. The frail old woman was last seen alive on Saturday-evening. She lived alone and is survived by two daughters. The SAPS brought in trauma-councillors to talk to the deeply upset residents – and they were also adviced that if they wanted to leave the home for a while and stay with their family and children for a while, they should do so, as it would help them come to terms with the murder of their friend, said manager of the complex Mr Willem Agenbag.  He said the home has excellent security and is monitored with closed-circuit TV 24/7 – however the cottages where Mrs Kilian was murdered were not included in the security system and they want to change that at once. The family also told police that the attackers must have drugged them somehow because the family had suddenly fallen asleep in front of the TV before they were attacked. Now, reports Beeld newspaper, the young man is being terrorised by the criminal fraternity. Marisa Phillips of Volksblad newspaper writes from Welkom that the youth’s mom Jackie, of Naudéville, said three more attempts were made to break into their home and people have been drawing red marks on a tree in front of their home to terrorise them.  The family is still in Bloemfontein however to be near the family patriarch, Riaan, who is in hospital for surgery after he was shot. A neighbour phoned Mrs Vermeulen to warn her that strange people had tried to get into the Vermeulen property on Saturday. ‘My neighbour’s husband yelled at those people to get out. The next morning they also saw the red cross scrawled on the tree and also that plastic bottles had been placed as field-writing markers atop our gate”. The security alarms were tripped thrice since the Sept 19 2010 incident. Security company officials have posted a guard inside their erf and the police are also watching the house. Two black-owned mining companies’  owners face criminal charges over dangerous pollution

November 23 2010 By A’Eysha Kassiem Judge Nathan Erasmus of the Cape High Court sentenced Thomas, the convicted murderer of Cape Town publisher Robin McGregor to a 30-year prison term.  He would be free after his 60th birthday. The popular publisher was murdered in 2008 in his Tulbagh home. His Mercedes-Benz and two safes were stolen. Judge Erasmus said: “Mr McGregor was killed in a brutal manner. He was stabbed with a knife multiple times and dragged across the floor in his corridor. The question is: ‘What kind of man does that?’ Especially with your background?” Judge Erasmus was referring to the fact that Thomas seemed to come from a “good home” and had also been able to study further and get a post-high school certificate. The murder had clearly shaken both the Tulbagh community and the Saron community, where Thomas was from. “It was not just because it was McGregor (who was killed), but because of the type of murder that was committed,” he said, referring to the brutality of the crime. “You are too young to understand where we come from as a society. “We are trying to build a nation and one of the biggest problems in terms of our democracy is crime. It undermines what we stand for,” said Judge Erasmus. Thomas claimed that his involvement in the murder was because he was “put under duress by members of the 28s gang” and said he was innocent. Judge Erasmus said it was necessary to underline the seriousness of the crime with the sentence. 2010-11-29 Amanda Roestoff  - KRUGERSDORP. Boer Julie Louw, 38, of the farm Rietfontein at Kromdraai near Krugersdorp, was discovered beaten comatose. A neighbour found the farmer next to his Toyoto Corolla’s opened doors and a flat tyre on the tar-road leading to his farm. He suffered ‘serious facial, leg and back injuries’ and was rushed to the local hospital, which appropriately enough was renamed after a communist ‘freedom fighter’ called Yusuf Dadoo. Doctors said the injuries show that he was assaulted by someone with a hatchet and another person with a knobkierie, a ‘traditional weapon’.

Warrant officer Dennis Jones believes that the Boer was attacked either late Friday evening or in the early-morning hours of Saturday November 28 2010. They confirmed that ‘an unknown number of men gained access to the Louw farmhouse.” They ‘could not say’ whether anything was robbed but they are not investigating attempted murder charges, only ‘armed robbery’. The farm is located near the Brookwood trout farm and the rural Kloofzicht Tourist Lodge. The police tried to interrogate the comatose farmer in hospital but unsurprisingly ‘were unable to communicate’ with him. And orse just as unsurprisingly no-one was arrested: the SAPS specialised farm-tracking units which could have followed their traces were disbanded during ex-pres Thabo Mbeki ‘s inept reign.

2010-11-29 Amanda Roestoff of Beeld newspaper reports that 37-year-old Afrikaner security-camera technician Riaan Petrus Velloen was beaten up so brutally by the Florida police in Roodepoort that the healthy man died in the police cells within just hours. There were no charges against Velloen when he died in police custody, said his mother-in-law Mrs Ria Hogan, 50, grand-mother of his son Kevin Hogan, 15.

“Police claim he was drunk but he was not a drinker. We don’t know why he was arrested and there have been no formal charges lodged through the charge office,’ she said. She said her daughter received a phone call from Riaan’s sister – who informed him that he was beaten to death in the police cells. SAPS spokesman Lt.col. Lungelo Dlamini indeed confirmed that Velloendied while in police-custody and that a ‘murder-dossier was opened to investigate ‘the incident’. Hogan said the family have no idea where he was arrested, or why.

“It’s so heart-sore, because he was a kind, loving man who always tried to make you happy even if he had to put his own needs last. The police should be there to protect people – one cannot trust them any longer.’

His son Kevin was devastated about his father’s death. “He always listened to everything I ever told him and I will miss all the special things we did together. Velloen’s remains have not yet been released for burial because the investigation has not been completed. The SAPS ‘would not say whether any of the arresting officers would be criminally charged or prosecuted in an internal hearing”.

The TV programme Third Degree, broadcast by ETV in South Africa, showed these pictures of the late Mr James Brown, a 09-year-old Afrikaner and also an Alzheimer’s sufferer,  who was arrested at the Shoprite supermarket in Kriel – for ‘taking a chocolate bar without paying for it’. Ryan writes: “The old man was assaulted,  beaten and sprayed with pepper spray by the police officers who arrested him without any probable course for their behavior towards him – the old man did not resist arrest and the police officers were never in any danger from him at any stage. This old man did not know he was doing anything wrong because he was an Alzheimer’s sufferer – his doctor said his physical health was good, but he did suffer from Alzheimer.  “After his arrest, his civil rights were also violated  because he had nobody to assist him and his right to a phone call was not presented to him otherwise he could have been assisted by a family member or attorney.  “He died within  four hours of custody at the Kriel police station. This is what he looked like after four hours in a police cell - alone . SAPS TORTURED AFRIKANER FARM FAMILY MALHERBE with CATTLE-PRODS, PLASTIC-BAG CHOKING TORTURE IN POTGIETERSRUST, JAN 28 2010

Heavily armed men in police uniforms who showed up in police vehicles tortured an Afrikaner farm family in Mokopane/Potgietersrust on January 28 2010 - tied them up, covered their heads in plastic bags and shocked them with cattle-prods. Injured were Okkie Malherbe (63) wife Emmerentia (53), of the Olem farm on Doelen, and watched by their little granddaughter Kaycee, 5. Malherbe's son WD, 34 said the attack took about two hours. The family had opened the door to their torturers because “they thought they were police officers”. Investigations found later that the attack-gang had indeed been members of the SAPS after investigators checked the police-vehicles’ number plates. Deaths in SA prisons often due to torture by officials:

Nov 29 2010 – CAPE TOWN PARLIAMENT. The portfolio committees of correctional services and public works held a joint hearing about the ‘fruitless, wasteful expenditure on the building of new facilities” and “the torture of prison inmates at the hands of officials”.

In one such unnatural death, a number of officials were charged with culpable homicide when an inmate was killed during a mass assault on prisoners by officials, yet only one was found guilty. He was dismissed. Charges against the others were withdrawn. The MPs wanted to know why they had not been charged with murder, and were told that the police would be investigating the criminal charge against the dismissed official.

They also queried the inhumane treatment of inmates who ended up killing themselves. In one case, an inmate was locked in a cell that had no lights and, in another, an inmate who said he had been raped was found hanged in the shower area of the cell. There had been “a delay in transferring him to a rape centre, allegedly because there was no transport available”. The nurses who failed to examine the man were acquitted in a disciplinary hearing, and the officials who failed to arrange his transport to a rape centre were given a final warning. The MPs were unhappy with the lack of action against errant prison officials.

A number of extremely worrying trends have been found during an investigation into 55 unnatural deaths in prisons in 2009. The Civil Society Prison Reform Initiative said one of the "top concerns" was that despite guilty findings at discliplinary hearings,  not one correctional services official had been prosecuted in a criminal court in any of the unnatural death cases.

This was despite disciplinary internal enquiries finding them guilty of offences such as gross negligence and excessive use of force. "Of topmost concern is that in not one of the 55 cases has a single Department of Correctional Services (DCS) official been prosecuted yet," the Initiative said.

  • "It is rare that officials are dismissed following the death of a prisoner."

The CSPRI - a project of the Community Law Centre at the University of the Western Cape - said it had analysed a report by the Judicial Inspectorate which provided details of 55 "unnatural deaths" in 2009. "The CSPRI has analysed the data, discovering a number of extremely worrying trends."

Deceased often brutally assaulted by officials:

It said in many of the cases, the deceased had been brutally assaulted by officials with batons, electric shields and booted feet. The official had then failed to provide "adequate and timeous" medical attention.

Nothing more than murder

In one case, involving the death of a 59-year old prisoner at Ebongweni Maximum Security Prison in Kokstad, an independent pathologist had found "death consistent with smothering" or an obstruction of mouth and nose.

  • "The incident happened on August 9 2009 and according to the inspectorate, no action has been taken by the DCS nor has the investigation by the police resulted in anything," the CSPRI said.

The prisoner, known only by his initials 'RT'", must have died a horrible death - first severely beaten and then suffocated. This is nothing more than murder and all officials implicated should be prosecuted and punished accordingly."

55% were suicides…

Other trends apparent from the 2009 Judicial Report indicated that 55% of the deaths were suicides. In a significant proportion of these, the prisoner was a known as a suicide risk. Despite this, "The DCS failed to take effective measures to prevent the suicide," the CSPRI said.

  • "In nearly 65% of the 55 cases, the DCS had not taken any action against its officials although there is evidence indicating liability."

Investigations by the police in the deaths of prisoners seldom progressed to a stage where a docket was handed to the National Prosecuting Authority (NPA).

"The CSPRI is of the view that when a person dies in state custody, the state is liable until the matter has been properly investigated by independent and competent authorities and the findings indicate the contrary.

"In meeting its obligations under the UN Convention against Torture, South Africa is obligated to investigate promptly wherever there are reasonable grounds to believe that an act of torture or ill treatment has been committed in any territory under its jurisdiction."
